Bould Consulting and Gerald Katz P.C. offer Caribbean construction clients the following services:

  1. Review, analysis and negotiation of construction contracts to seek “win-win” provisions where possible.

Our Experience

Bould Consulting and Gerald Katz P.C. as CCAS are particularly well-equipped to assist Caribbean clients in the resolution of construction problems are:

  1. familiar with the unique logistical requirements and other means and methods common to the construction process in the Caribbean;
  2. conversant with the various contracting and development methods normally employed in the area such as lump sum, guaranteed maximum price (“GMP”), multi-prime, construction management and design-build;
  3. knowledgeable about the forms of contract (FIDIC, RIBA, CDB, World Bank, European Union and AIA, IFC98, TTIA82, BIA etc) used on Caribbean projects;
  4. experienced in the negotiation and analysis of complex construction contracts;
  5. experienced in the analysis of complicated performance problems;
  6. experts in the English and American legal principles governing the interpretation of construction contracts and the resolution of construction disputes in the region;
  7. experienced in the analysis of construction project documentation and the organization and presentation of project documents to support the client’s position;
  8. experienced in the calculation and proof of construction damages;
  9. experienced in the preparation and presentation of expert reports and testimony necessary to prevail in Caribbean construction disputes; and<
  10. experienced in the representation of clients with complex claims before arbitration boards, courts and other tribunals.

 

Our Fees

With our knowledge and experience in the Caribbean region, we are able to provide our clients with what they require from their consultants and attorneys, i.e., informed and timely advice rendered in an economical manner. Our fee structure reflects this. For many assignments, we offer a not-to-exceed or lump-sum fee. This fee basis is appropriate for such tasks as reviewing and proposing revisions to contract documents, preparing and/or reviewing claims, or preparing opinions on issues which arise during performance.

In other instances, particularly those which require on-going assistance (for example, representation of the client in a mediation, arbitration or in litigation), we are prepared to negotiate a mutually-acceptable fee on an hourly or other basis.

In addition to our fees, we are reimbursed for our costs.

Regardless of the fee structure chosen, we are mindful of our clients’ sensitivities to fees and are equipped to offer valuable and cost-efficient services.
